I recently considered signing a property management agreement with Utopia Management, but I ultimately decided not to proceed due to several concerns with their terms and practices. Here are the key reasons for my decision:

1) Lack of Transparency: Important fees, such as the marketing fee and eviction services, were not disclosed during our initial phone conversations. During the phone call, the rep emphasized only a monthly property management fee applied. Transparency is critical when entering into a professional relationship, and these omissions were a red flag for me.

2) Excessive Fees: The contract includes uncapped charges for extraordinary services and vendor coordination, which could lead to significant unexpected costs.

3) Limited Owner Control: The agreement grants Utopia almost full authority over tenant selection, repairs, and leases, leaving owners with little say in crucial decisions. The contract imposes penalties for rejecting a tenant approved by Utopia, including one month's rent, a $500 administrative fee, and reimbursement of the tenant’s application fees, leaving property owners with limited flexibility in tenant selection. If rejecting tenants leads to termination of the contract, you may be subject to early termination penalties, such as half of one month’s rent per unit under management.

4) Liability Issues: I found it troubling that the contract makes property owners liable for claims against Utopia, even if those claims arise from their own negligence or errors. This is not in line with industry standards.

5) Restrictive Sales Clause: If you decide to sell your property, you’re required to use Utopia as your listing agent and pay a significant commission, even if the management agreement has been terminated.

Additionally, I noticed that many of the glowing reviews posted about this company seem suspicious. If you check the reviewers' profiles, most only have one or two reviews, which raises questions about their authenticity.

While Utopia Management may work for some, I encourage property owners to carefully read the contract and consider whether these terms align with their needs. I personally would not recommend this company unless these concerns are addressed.
